Because this employee’s need for leave is based on a work-related injury [research and verification], you should grant the leave of absence and immediately file a workers’ compensation claim [recommendation]. Even though this is covered under WC, both the federal ADA and state FEHA laws require that you engage in the interactive process in order to make reasonable accommodations [research] and denying the request can be deemed as retaliation [support].
