Maybe under the TEACH (distance learning) act. 3) A fair use analysis would need to be done to determine is the copying is justified. That fact that it's being used for non-profit purposes (education) is in his favor. The fact that the play is fiction does not. The teacher needs to determine if the portion he's using is small enough and if it would have any reasonable effect on the copyright holder's potential market for the work. If he is posting the audio file online for an online class, and the posting prevents students from downloading the audio file, then the TEACH Act may apply. The TEACH Act allows him to upload a "reasonable and limited" portion of the work so long as it is the smallest amount that can be used for educational purposes and the copyrighted CD is the best reasonably available source for the material.

Since the CD was purchased there are probably licensing requirements in place that may prohibit posting the images on a website. Posting online would be a violation of contract law and not copyright law.
