If you don't document, it never happened.
What if the employee's accommodation request is not clear?
Contact the employee to confirm what their provider has recommended as an accommodation that will allow them to perform the essential functions of their job.
Is COVID a disability?
Yes, having long COVID can be a disability under the ADA. If it substantially limits one or more major life activity.
When should you 'Incomplete' a PIF?
Incomplete physician information (signature/specialty); incomplete or missing limitations; it is not clear how the employee's disability impact their essential job duties; dates of incapacity and/or F&D of the recommended accommodation.
What is the process when uploading documents from Work Partners?
Save the document as a PDF then upload the document to Leave Source. Click the 'Review Button' in LS notifying the LOA Analyst that the document has been uploaded.

Should an employer invite the employee to suggest accommodations?
Yes, the employee may have good accommodation ideas, but may be hesitant to bring them up without being asked to do so.
When reviewing ADA medical information what should you look for first?
The major life activity that is limited.
If the Physician Inquiry Form is missing ADLs affected, do you incomplete?
You may not have to if you are able to conclude what major life activities are being affected.
When answering an email what should you do?
Review the employee's leave record and eSTAR, analyzing their whole leave story, prior to answering the question.
What leaves run concurrently?
FMLA and NJ FLA
Review to confirm that the form is complete, the employee meets the definition of a disability, the recommended accommodation(s), and their duration are appropriate for the disability.
How do you accommodate an employee with an intellectual impairment?
Flexible schedule, additional training, job coaches, written instructions, timers, color coded systems, and extra time to complete a task are all considered accommodations.
If the provider states "No" to the employee being disabled, how do you handle?
Some physician's check "No" not understanding the question. You may be able to conclude what major life activities are being affected therefore confirming that the employee is disabled. An outreach to the employee can be done if the information provided is vague.
What should you do first when creating an FMLA leave?
Make sure the employee meets the eligibility requirements for FMLA as of the requested start date for their leave, including but not limited to confirming their productive hours worked in eSTAR.
